In New York, there are seven legally acceptable grounds for divorce. A no-fault divorce can be brought due to an irretrievable breakdown in the relationship for a period of at least six months. A no-fault divorce can also be brought on the grounds that partners have lived separate and apart for more than one year following the execution of a separation agreement. The separation agreement lays out the rights and responsibilities of both you and your spouse, including division of property, child custody, parenting schedules, child support and spousal maintenance.
