Know And Protect Your Rights
In New York, there are seven legally acceptable grounds for divorce. The attorneys of Phelan Phelan & Danek LLP are well-versed in each, and can help guide you to a resolution of your situation regardless of the reason for your divorce. Based upon recent changes to New York state law, today, the most common type of divorce is a no-fault divorce. A no-fault divorce can be brought due to an irretrievable breakdown in the relationship for a period of at least six months. A no-fault divorce can also be brought on the grounds that partners have lived separate and apart for more than one year following the execution of a separation agreement. The separation agreement lays out the rights and responsibilities of both you and your spouse, including division of property, child custody, parenting schedules, child support and spousal maintenance. Before signing this critical document, please give us the opportunity to meet with you. From signing a separation agreement, to negotiating or litigating your case, ensure that your best interests and the rights of you and your family are protected by discussing your case with Phelan, Phelan & Danek LLP‘s compassionate attorneys.
