Appellate Practice

At Phelan, Phelan & Danek LLP, our attorneys understand that appealing a case is far from easy.

Succeeding in a complex appeal requires skillful attorneys presenting creative arguments that seamlessly combine a persuasive logic with legal authority and clear reasoning.

The firm’s appellate lawyers are not only experienced counselors, but also skilled researchers, legal analysts and persuasive writers. They know how to examine a case, research the issues and write a simple, compelling legal brief.

In addition to presenting well-researched, clear legal arguments on appeal, our appellate attorneys have the knowledge and judgment to make proper choices as to the various procedural options.

More About Attorney Tim Brennan

Tim Brennan, the head of the firm’s appellate department, served as appellate court attorney for the Appellate Division 3rd Department. This insider experience provides the ability to reach tactical conclusions consistent with the customs and practices of various courts that may not be explicitly embodied in the rules.

A History Of Success

Our appellate department has distinguished itself in a number of significant cases in federal and state appellate court systems, including the Court of Appeals, the highest state court in New York.

We have successfully represented clients in complex appellate litigation across all areas of civil law, and in appeals of final orders, interlocutory appeals and Article 78 proceedings, wherein the Appellate Division is the court of original jurisdiction.

Our lawyers handle appeals from administrative agency rulings at the local, state and federal levels.

Super Lawyers selects attorneys using a patented multiphase selection process. Peer nominations and evaluations are combined with independent research. Each candidate is evaluated on 12 indicators of peer recognition and professional achievement. Selections are made on an annual, state-by-state basis. The objective is to create a credible, comprehensive and diverse listing of outstanding attorneys that can be used as a resource for attorneys and consumers searching for legal counsel. Since Super Lawyers is intended to be used as an aid in selecting a lawyer, we limit the lawyer ratings to those who can be hired and retained by the public. Prior client results do not guarantee a similar outcome.
